The incident allegedly occurred when Emma, 33 at the time, descended the slide, which stands approximately 214 feet above a pool. The impact of the slide and the plunge into the pool reportedly caused Emma’s clothing to painfully bunch between her legs, forcing water inside her body. She experienced immediate and severe internal pain, and upon standing up, noticed blood rushing from between her legs. Emma was subsequently transported to a local hospital and later to another hospital for specialized treatment.
In their lawsuit, the McGuinness couple argues that while there are inherent risks associated with attractions like the Humunga Kowabunga slide, Disney should have been aware of specific risks that could arise and failed to disclose these risks to guests. They maintain that the slide was unsafe and unreasonably dangerous due to its failure to meet the expectations of a reasonable consumer.
